AVM Maisaka Murder: Kaduna High Court Sets Jan 23, 2024 For Adoption Of Final Addresses

In continuation of the court hearing of late Air Vice Marshal Muhammad Musa Umar Maisaka murder, which took place on November 8, 2021, the Kaduna State High Court 09 has adjourned the hearing of the case to January 24, 2024 for the adoption of final written addresses before the court deliver judgement.

Speaking in an interview after the court proceedings on Thursday November 09, 2023, the state government lawyer, Barr Joseph Marcus Bobai explained that the process has been going on smoothly right from the beginning and they expect a fair judgement at the end of the day.

He added that, the court has closed hearing of the case from all parties and has adjourned the case to January 23, 2024 for them to come and adopt their final written addresses before the court delivers judgement, while they are expecting justice.

He said “It’s not for us to get conviction at all cost but for the public to be seen that the process leading to judgement was free and fair. Justice is not just one sided, it is a all round thing, justice for the family, justice for society that in this case is kaduna state government who’s law has been violated by killing a citizen and also justice to the deceased family and so we expect justice.

“As you know, there are other defendants that we listed them in the charge as unknown person’s which is allowed in law when you don’t know the identity of the person who committed the crime, and we do not know them, so we had to like proceed with the defendant, who is the person we know and if eventually the identity of other persons are uncovered, subsequently we still proceed to arrest them has we have done in the defendant standing trial at the moment.”

Also Speaking, the Counsel representing the family of the deceased person, Barr. Nuhu Ibrahim disclosed that the proceedings are so far good hence the prosecution has since closed it case and the defendant Mohammed Giwa has present himself as his witness, while the case is adjoined to January 23, 2024 for adoption of final addresses.

“Actually, the essence of trial is known thing that even when someone is telling the truth it will come open and so if someone is also telling the lies, so in this case it is very surprising that the defendant who’s denying knowing anything about the allegations is now given statements that are contradictive.

“At first, he admitted the statement he gave to the police, but at the moment he has denied everything, so it’s very clear that there’s a clear contradiction and as far as we are concern, that will work against him, so the proceedings is going normal and we appreciate the court for handling the matter the way it is going.”

While responding, the defendant’s lawyer, Barr. Chris A. Ekhasemomhe disclosed that they are satisfied with the proceedings, especially that the judge has granted them the audience to present their own witnesses during the seating, and the accused denied any involvement in the killing of the late deceased AVM Maisaka.
